Representation before the Polish National Labor Inspectorate (PIP)

A PIP (National Labor Inspectorate) inspection at a transport company is more than an inspector's visit - it is a review of driver contracts, working time records, and tachograph data that can end in a fine of up to PLN 60,000.00. Representation before PIP means that an Evotax representative takes over contact with the inspector, prepares the documentation, and handles the formalities - you run your business, not the inspection.

What goes wrong when you handle a PIP inspection yourself?

A PIP inspector rarely announces a visit to a transport company in advance - the Act on the National Labor Inspectorate allows them to skip prior notice if it could affect the outcome of the inspection. If your documentation is not ready at that moment, every additional hour of the inspection increases the risk of error.

Financial risk

Labor law violations are punishable by a fine of PLN 2,000.00 to PLN 60,000.00, and a ticket issued by the inspector can reach PLN 5,000.00, regardless of separate penalties under the Polish Road Transport Act for irregularities in drivers' working time. If the inspector finds irregularities, they are required to notify ZUS (social security) and the tax office - a single PIP inspection can trigger further, independent proceedings.

Time and regulatory complexity

The Polish Act on Drivers' Working Time, tachograph data, records of driving hours and rest periods - this is material you need to know by heart during an inspection, not look up along the way. The owner of a transport company rarely has time for this while managing the fleet and customers day to day.

Risk of contract reclassification

Companies using civil law contracts or B2B contracts with drivers are under particular scrutiny today. If a driver's work is organized like regular employment - fixed hours, subordination, no real independence - the inspector may challenge the entire basis of the cooperation, with consequences extending to ZUS settlements.

What does PIP check during an inspection?

A PIP inspection at a transport company focuses on four areas: driver working time records, breaks and rest periods, working time limits, and business travel documentation. The inspector compares this data with tachograph records and HR documentation to assess whether the carrier complies with the Polish Act on Drivers' Working Time.

Working time records

Working time records are the first document a PIP inspector checks. They verify whether the entries reflect actual driving time, on-call duty, and night work. Errors in the records are the most common cause of financial sanctions for carriers.

Breaks and rest periods

The inspector compares tachograph records with working time records to check whether drivers were given the required breaks and daily and weekly rest periods. Irregularities in this area are among the most common causes of penalties in transport.

Compliance with maximum limits

PIP checks whether the company complies with daily and weekly driver working time limits and whether overtime is properly compensated. Exceeding the limits can result in an order to remedy the irregularities or a request to penalize the employer.

Business travel documentation

The inspection also covers settlements of per diems and lump sums for drivers' business trips, including trips abroad. Errors in this documentation increase the risk of disputes as well as tax and HR consequences.

How Evotax represents your company before PIP

Representation before PIP means formally taking over contact with the labor inspector and the documentation duties during an inspection at a transport company. In practice, this involves five stages of cooperation.

1

Power of attorney

You sign an authorization, and Evotax takes over formal contact with the inspector - from the start of the inspection to the closing of the report.

2

Documentation audit

We check driver contracts, working time records, and tachograph data before the inspector does.

3

Support during the inspection

We answer the inspector's questions and compile documents on request, so the inspection runs without disrupting your company.

4

Inspection report

We analyze its content and, if needed, prepare objections within the statutory 7-day period from the presentation of the document.

5

Corrective measures

If the inspector issues an order to remedy irregularities, we implement the changes together with your team, so the next inspection does not find your company in the same place.

We provide PIP representation alongside driver working time settlement - the documentation we prepare on an ongoing basis is the same material the inspector requests during an inspection.

Handling a PIP inspection yourself or representation by Evotax - which pays off more?

Many business owners try to handle a PIP inspection on their own - until a documentation error ends in a fine. Representation by Evotax lets you shift that risk to a specialist who knows inspection procedures in transport inside out. Compare the costs and risks of both approaches:

Cost

Your time and attention diverted from day-to-day business - with no price tag, but a real loss

From PLN 200.00/h as part of the driver working time settlement package, included in the price of the PRO package

Risk of error

On the company's side - a fine of PLN 2,000.00 to PLN 60,000.00 for labor law violations

On Evotax's side - we act under a power of attorney and follow well-known inspection procedures

Knowledge of procedures and the law

You have to track the PIP Act, deadlines, and inspection practice in transport on your own

We keep up with the procedures and the typical questions inspectors ask in transport

Contact with the inspector

The owner or manager must be available in person throughout the inspection

The representative takes over contact - you do not need to be present for the entire inspection

Documentation preparation

Compiling documents, often under time pressure, on the day of the inspection

Audit and preparation of documentation before the inspection as part of other Evotax services

Why Evotax - and why now?

A general accounting firm does not know the specifics of transport. The Mobility Package, cabotage, driver working time records, and cross-checks between PIP, ZUS, and the tax office - for us, this is daily practice, not a topic to read up on.

The cost of delay

The longer your documentation waits for an audit, the more questions the inspector will ask without an answer prepared in advance. A PIP inspection does not wait until your company is ready.

Specialization in transport and logistics

You do not have to explain to us what driver working time records or cabotage are - we know, and we work in this industry every day.

One representative for multiple institutions

We represent your company before PIP, ITD (Road Transport Inspection), ZUS, and the tax office - instead of looking for separate help for each inspection, you have a single point of contact.

Inspection practice in transport

We have supported companies inspected by the National Labor Inspectorate for years. Your documentation is prepared for the questions that are actually asked during inspections in the transport and logistics industry.

Representation Before PIP - Pricing

You can order representation before PIP as a one-off service for a specific inspection or as part of ongoing driver working time settlement - in the second option, the rate is lower and your account manager is already familiar with your fleet's documentation.

Representation Before PIP - Frequently Asked Questions

Does a PIP inspector have to notify the company of an inspection?

Not always. A labor inspector must report their presence before starting inspection activities, but may skip this if prior notice could affect the outcome of the inspection. In practice, PIP inspections at transport companies are often unannounced, unlike ITD inspections, which the business owner is informed of in advance.

Can I authorize an accounting firm to represent my company before PIP?

Yes. Under a power of attorney, the representative can take over formal contact with the inspector, prepare documentation, and answer questions during the inspection. The business owner does not have to be present in person for the entire duration of the inspection.

What are the penalties for a transport company that does not keep driver working time records?

Missing or incorrectly kept driver working time records are among the violations most frequently found during PIP inspections in transport. They are punishable by a fine of PLN 2,000.00 to PLN 60,000.00.

Can a B2B contract with a driver be deemed an employment contract during a PIP inspection?

Yes, if the inspector finds that the way the driver's work is organized actually corresponds to an employment relationship - fixed hours, subordination, and no real independence - regardless of what the contract is called. Such reclassification has consequences for ZUS and tax settlements for the entire period of cooperation.

How long does a PIP inspection at a transport company take?

The length of the inspection depends on its scope and the size of the company - it may involve a single visit or several days of the inspector's work on the documentation. Once the activities are completed, the inspector draws up a report, and the inspected party has 7 days to file objections.
