What exactly does Evotax's service for the legalization and employment of non-EU foreigners include?

At Evotax, we provide comprehensive services for the legalization of residence and employment of non-EU foreigners, ensuring compliance with regulations and optimizing processes. Our services include:

Employment legalization based on a declaration

Legalizing the employment of non-EU foreigners based on a declaration can be completed in as little as 7 days with minimal documentation. Under this option, the company submits a declaration to the tax office stating its intention to employ a specific person in a designated position from the declared start date.

This declaration is valid for 2 years, after which the foreigner must present it to obtain a Polish "D" visa.

Important! Employment legalization for non-EU foreigners in Poland is available only for citizens of Ukraine, Belarus, Moldova, Georgia, and Armenia!

Employment legalization with a work permit

Legalizing the employment of non-EU foreigners with a work permit takes 3 to 8 weeks and requires more documentation. As part of this service, we assist in navigating the administrative process and obtaining a permit for a specific employee to work in a designated position from the declared start date.

The work permit is issued by the Provincial Administration and is necessary to obtain a Polish "D" visa. The document is valid for 1 to 3 years.

Legalization of residence for foreigners with a residence permit

Legalizing the residence of foreigners with a residence permit is a solution for those who are already working or staying in Poland, and we are happy to assist with the process! Whether it concerns temporary or permanent residence, as well as residence cards, we provide full support. However, it is important to note that this process can take 2 to 5 months for qualified workers (e.g., C+E truck drivers) and 6 to 9 months for positions requiring fewer qualifications.

The complexity of the residence legalization process for non-EU foreigners depends on various factors, such as the type of permit, the individual's actual residence status, their address (and administrative office jurisdiction), job position (qualification level), and several other aspects. Additionally, obtaining a residence permit in Poland requires the foreigner to have a registered address in Poland.

Other ways to legalize the residence of non-EU citizens

We also assist with other residence legalization options, which are ideal for workers who are not yet employed and/or residing in Poland. These include:

  • Type "D" Visa – We assist in submitting an application to the Polish Embassy in the foreigner’s country of residence. Currently, obtaining this visa is not possible within Poland.
  • Type "D" Visa from Another EU Country – It is possible to legally employ a foreigner in Poland using a visa issued by another EU country.
  • Biometric Passport – Citizens of certain countries (such as Ukraine, Georgia, and Moldova) can enter the Schengen zone with a valid biometric passport. However, work under this status is limited to a maximum of 90 days within 180 days.

FAQ

What documents are required to employ a non-EU citizen?

It depends on the specific situation. For some candidates (citizens of Ukraine, Belarus, Armenia, Georgia, and Moldova), minimal documentation may be required (e.g., just a passport). For others, in addition to a passport, qualification certificates or diplomas with certified translations may be necessary. Moreover, for job positions without officially recognized demand, local recruitment efforts may be required before obtaining a work permit.
